                         Recently a young Australian man came to me seeking advice about a minor incident that had occurred during a drunken night out. The Australian man had told me that he was out with friends and after the result of much drinking had lost recollection of the night in detail. Gathering from his friends that were with him on the night and his own memories he pieced together that he was involved in an incident with a young Thai woman.

                        This incident resulted under Thailand law in the accidental injury of the Thai woman which was the product of drunken frivolity, the injury was a cut to her left eyebrow which required seven stitches. He explained to me that they had both fallen over accidentally whilst dancing and she had hit her head on a table edge. At the time his friends that were with him said that they would take care of the situation and help him out but all they did was give the woman his phone number, which ended in countless aggravating phone calls regarding her situation.

                        The Australian man told me that he was happy to pay for the medical expenses caused by the accident but that the Thai woman was not happy with the amount and is only interested in extorting him for money in this case asking for one hundred thousand baht compensation. This is obviously not fair under Thailand law as it was an accident as both of them had fallen down and the Australian man did not mean to intentionally hurt the girl.

                        Our comment: Because the whole incident was an accident of this there is no Thai law holding him liable for any criminal wrongdoing simply because her injury is not considered severe. A prosecutor cannot legally prosecute him through a criminal case but the Thai woman can sue the Australian man by submitting a civil case requesting compensation for the injury. What we know is the medical bill is not expensive and the Australian man is willing to pay twenty thousand baht including compensation for the accident. But the Thai woman did not agree with the amount and was only interesting in financial gain and thus the problem has still not reached its conclusion. So if you are planning a big night out please take care and be aware that not all problems can be easily fixed follow Thai law.
